Penalties for DUI & Other Criminal Charges
Penalties for criminal charges can vary greatly depending on the type of charge, whether it is classified as a felony or misdemeanor, whether there are any enhancements to the charges, prior convictions for similar charges, and other variables. Some charges have a set minimum and maximum penalty schedule, while others are more general.
For example for a first Offense DUI charge the minimum and maximum penalty can range from:
Jail: 48 hours to 6 months
Fine: $390 to $1,000 plus penalty assessment (ie. Approximately $1,800 or more inclusive of penalty assessments)
Probation: 3 years to 5 years
Alcohol program: 3 months to 9 months
AA meetings, Community Service, Community Labor, Mothers against drunk driving course, etc.
If you are charged with a second or more DUI, or other enhancements, the potential penalties can increase.
That does not mean that just because you are charged with a DUI, that you have to be convicted of a DUI. It is possible to get the DUI charges dismissed completely or reduced to a lesser offense with lesser penalties. I have been very successful in getting DUI charges, as well as other criminal charges, dismissed in Van Nuys Court.
DMV Hearing: Further, if you are charged with a DUI, then you likely need to request a DMV hearing to fight against the DMV suspending your drivers license. The DMV hearing will take place in Van Nuys for most (if not all) DUI arrests that take occur in San Fernando Valley.
