Question: I was arrested for a DUI on ventura blvd., and now have a Van Nuys DUI court date and need a good local van nuys dui attorney. First question…are DUI checkpoints for drunk drivers even legal? They were pulling over a lot of cars for no reason.

Answer: Well, in short, they are legal when they are properly conducted…but they are not always properly conducted. In which case a motion to suppress can be run and the DUI charge potentially dismissed. There are a list of factors they need to follow, including properly publicizing the check point, having a set pattern for how they stop cars, etc. (ie. it is not supposed to be subjective). Feel free to call me to discuss in more detail. My office is down the street from Van Nuys court.

Sincerely,
